The legal dispute surrounding the potential presidential ambitions of former Nigerian leader Goodluck Jonathan has entered a new phase, with an appeal now filed against a Federal High Court judgment that cleared him to contest future presidential elections.

An Abuja-based lawyer, Jideobi Johnmary, is asking the Court of Appeal to overturn the earlier ruling delivered by Justice Peter Lifu, arguing that significant procedural errors affected the outcome of the case.

Appeal Focuses on Fair Hearing Concerns

At the center of the appeal is the claim that the trial court improperly handled a request seeking the judge’s withdrawal from the case.

According to Johnmary, the lower court should have first resolved the application questioning the judge’s impartiality before proceeding to hear the substantive matter. Instead, both issues were reportedly considered together, leading to a combined decision.

The appellant argues that such an approach undermined his constitutional right to a fair hearing and compromised confidence in the judicial process.

Challenge to Judicial Procedure

The appeal maintains that a motion seeking a judge’s recusal is a fundamental issue that must be addressed before any substantive arguments are entertained.

In essence, Johnmary contends that once questions arise regarding a judge’s neutrality, resolving those concerns should become the court’s immediate priority.

He further argues that proceeding with the main case before determining the recusal application created procedural defects that should render the entire judgment invalid.

Dispute Over Multi-Million Naira Cost Award

Beyond the eligibility ruling itself, the appellant is also contesting the financial penalties imposed by the court.

The Federal High Court awarded ₦20 million in costs to Goodluck Jonathan, while an additional ₦1 million was granted in favour of the Attorney-General of the Federation.

According to Johnmary, the amount awarded was excessive and punitive. He insists that court costs should reflect actual litigation expenses rather than operate as a deterrent against citizens exercising their legal rights.

Request for Fresh Hearing Before Another Judge

As part of the reliefs being sought, the appellant wants the case reassigned to a different judge of the Federal High Court for a completely fresh hearing.

The respondents listed in the appeal include Goodluck Jonathan, the Independent National Electoral Commission (INEC) and the Attorney-General of the Federation.

Background to the Eligibility Dispute

The original lawsuit questioned whether Jonathan, having previously taken the presidential oath of office on two occasions, could legally contest for the presidency again under provisions of the Nigerian Constitution.

The plaintiff also requested orders preventing the former president from presenting himself as a candidate and restraining INEC from accepting any future nomination linked to him.

However, Justice Peter Lifu rejected those arguments, ruling that earlier court decisions had already addressed the issue of Jonathan’s eligibility.

The judge also held that the plaintiff failed to demonstrate sufficient legal interest in the matter and described the suit as lacking merit.

Political Interest Surrounding Jonathan’s Future

Although Goodluck Jonathan has yet to formally declare an intention to run in 2027, political discussions surrounding his possible return continue to attract attention.

Recent developments have intensified speculation, particularly following reports that a faction of the People’s Democratic Party (PDP) led by Kabiru Turaki expressed support for Jonathan as a potential consensus presidential candidate.

As a result, the outcome of the appeal may be closely watched by political stakeholders ahead of the next election cycle.
