Femi Falana Questions Legitimacy of New Tax Laws Ahead of 2026 Implementation

Prominent human rights lawyer Femi Falana (SAN) has questioned the enforceability of Nigeria’s recently passed tax laws, stressing that their implementation cannot proceed until lingering concerns over their legality are addressed.

Speaking from his hometown in Ilawe-Ekiti on Wednesday, Falana cautioned that the federal government should have resolved outstanding issues in the final days of 2025 and provided officially certified copies of the legislation before the January 1, 2026 commencement date. “If that was not done, the government would put itself in trouble by deciding to implement the laws. There are interest groups ready to challenge the legitimacy of the laws,” he warned.

Despite the criticisms, President Bola Tinubu confirmed on Tuesday that the new tax laws will come into effect as planned on January 1, 2026. He explained that the reforms are designed not to increase taxes but to harmonize the fiscal framework and strengthen Nigeria’s economic foundations.

In an official statement, President Tinubu assured the public that his administration remains committed to due process. He emphasized that collaboration with the National Assembly and other stakeholders will continue to resolve any technical concerns in the legislation.

“The new tax laws, including those enacted on June 26, 2025, and the remaining acts set to commence on January 1, 2026, will proceed as scheduled. These reforms are a once-in-a-generation opportunity to build a fair, competitive, and robust fiscal foundation for our country,” the statement read.

He clarified that the measures aim to reset structural inefficiencies, drive harmonization, and safeguard dignity while strengthening the social contract. “I urge all stakeholders to support the implementation phase, which is now firmly in the delivery stage,” he added.

Addressing public concerns about alleged post-passage changes to the laws, President Tinubu stated, “No substantial issue has been established that warrants a disruption of the reform process. Absolute trust is built over time through making the right decisions, not through premature, reactive measures.”

The president concluded by reiterating the government’s commitment to transparency and fairness, assuring Nigerians that the Federal Government will continue to uphold a tax system that promotes shared responsibility and sustainable prosperity.
