A Chief Magistrate Court sitting in Abuja has dismissed a criminal defamation suit instituted against Nollywood star Elizabeth Aishat Anjorin, widely known as Lizzy Anjorin, after determining that the matter was improperly presented before the court.
The case, identified as CR/25/20225, was initiated by Audullahi Adebimpe Mosadoluwa, who is married to a Lagos-based real estate developer, Ibile. She accused Lizzy Anjorin and her co-defendant, Shakira Ayobami, of criminal defamation, conduct capable of disturbing public peace, and allegedly making false and malicious claims.
During proceedings, the defence team, led by counsel A.U.E. Ogboi, raised a preliminary objection challenging both the competence of the complaint and the jurisdiction of the court to entertain the case. They also questioned the validity of the legal processes used to summon the defendants.
After considering submissions from both parties and reviewing relevant legal authorities, Magistrate Sunday A.A. Adukwu resolved all the issues in favour of the defendants, ruling that the suit lacked merit.
The court held that the complainant did not comply with provisions of the Administration of Criminal Justice Act (ACJA) 2015, noting specifically that multiple allegations were combined in a single criminal complaint instead of filing separate counts as required by law.
It was further observed that all individuals involved in the dispute reside in Lagos State rather than the Federal Capital Territory, a factor that also affected the court’s authority to hear the matter.
Based on these procedural shortcomings, the magistrate concluded that the complaint was fundamentally defective and amounted to an abuse of court process. Consequently, the case was struck out for being incompetent.
In addition, the court ordered the complainant to pay ₦50,000 as costs to Lizzy Anjorin and Shakira Ayobami.
