A legal attempt to restrict Ireti Kingibe, the senator representing the Federal Capital Territory, from participating in the affairs of the African Democratic Congress (ADC) has been dismissed by the Federal High Court in Abuja.
Presiding over the matter, Justice Peter Lifu refused to grant an urgent request filed by certain ward leaders seeking to immediately bar the lawmaker from engaging in party activities.
The application, which originated from executives in Wuse Ward, alleged that the senator had been suspended over claims of anti-party conduct. However, instead of issuing a restraining order, the court insisted that due process must be followed.
Gossip News Now reports that the judge directed the applicants to formally notify Ireti Kingibe of the allegations, ensuring she has the opportunity to respond before any legal decision is taken.
Reframing his position, Justice Lifu emphasized that political disputes require careful judicial handling, noting that fairness cannot be achieved without hearing both sides of a case. He stressed that decisions affecting party participation must not be made unilaterally.
The court’s stance effectively means that the senator remains free to operate within the party pending a full hearing of the matter. The case has now been scheduled for further proceedings on April 20, 2026.
At the heart of the dispute are allegations raised by the plaintiffs, including claims of misconduct and actions said to be contrary to party rules. They also argued that her suspension followed internal procedures and was backed by a significant portion of ward executives.
Their demands, when reorganised, included preventing the senator from:
- Representing the party in any official capacity
- Attending internal meetings or functions
- Interfering with ward administration or records
Despite these claims, the court declined to impose any immediate restrictions without first hearing from the senator.
Adding another dimension to the case, legal counsel representing Ireti Kingibe indicated that a formal objection has already been filed, signaling that the matter could evolve into a broader legal contest.
Commentary & Analysis
The court’s refusal to grant an ex parte order highlights the judiciary’s cautious approach to political disputes. By prioritising fair hearing, the ruling reinforces the principle that internal party conflicts must still adhere to legal standards.
This development also underscores the tension between party authority and individual political rights. While parties have mechanisms to discipline members, such actions must withstand judicial scrutiny.
As the case progresses, it could set a precedent for how similar disputes are handled, particularly regarding suspensions and participation rights within political parties in Nigeria.
