Fresh legal controversy has emerged following allegations from the camp of former Attorney General of the Federation, Abubakar Malami (SAN), accusing Nigerian security institutions of actions that allegedly infringed upon his constitutional protections after charges were brought against him.
According to a statement released through his media aide, Mohammed Bello Doka, concerns were raised over what Malami’s legal team described as a troubling pattern surrounding his arrest and detention after proceedings initiated by the Economic and Financial Crimes Commission (EFCC).
Rather than disputing the legal process itself, the former minister’s office argued that procedural conduct by authorities undermined his right to prepare an adequate defence. Central to the complaint was an alleged delay in fulfilling bail requirements despite a Federal High Court order granting his release.
The statement claimed that although bail conditions required submission of international passports, the EFCC allegedly took several days to forward the documents to the court, thereby prolonging Malami’s stay in custody even after judicial approval for his release had been secured.
Rearrest and Detention Claims
Shortly after leaving the Kuje Custodial Centre, Malami was reportedly taken into custody again by operatives of the Department of State Services (DSS). His aides alleged that he remained detained for multiple days without contact with family members or unrestricted access to his legal representatives.
According to his team, access to counsel was only granted after a period of isolation, which they argued occurred during a crucial phase when legal preparation was required for ongoing forfeiture proceedings before the Federal High Court.
At another point in the statement, his representatives emphasized that preventing consultation with lawyers directly affects an accused person’s ability to respond effectively to legal accusations. They maintained that such restrictions amount to interference with due process.
Concerns Raised by the Legal Team
Rather than presenting accusations in chronological order, Malami’s office framed its grievances around broader legal principles:
- Respect for court-issued bail decisions
- Timely compliance with judicial directives by enforcement agencies
- Protection of detainees’ access to legal counsel
- Investigation procedures conducted before, not after, arrest
His aides suggested that reversing this sequence risks weakening public confidence in the justice system.
The statement further warned that coordinated delays, rearrests, or administrative obstacles could be interpreted as attempts to bypass judicial authority. Malami, however, reaffirmed his willingness to contest the allegations through lawful channels.
Commitment to Legal Defence
Despite the dispute, the former minister reiterated his readiness to defend himself openly in court. His office stressed that adherence to constitutional safeguards remains essential regardless of the individual involved, noting that rule of law principles must apply equally to all citizens.
Commentary & Analysis
The dispute highlights long-standing tensions in Nigeria between anti-corruption enforcement efforts and debates over civil liberties. High-profile investigations often attract intense scrutiny, especially when questions arise regarding procedural fairness.
Legal analysts observe that allegations involving delayed bail execution or restricted access to counsel frequently become focal points in politically sensitive cases. Such claims, whether proven or disputed, underscore the importance of transparent compliance with court orders.
From a governance perspective, the controversy illustrates a broader challenge: balancing aggressive law enforcement with strict observance of constitutional rights. Public perception of justice depends not only on prosecuting alleged wrongdoing but also on ensuring that investigative processes remain impartial and lawful.
As proceedings continue, attention is likely to shift toward judicial review and institutional responses that may clarify whether established legal standards were fully upheld.
