The Rivers State House of Assembly has raised concerns over alleged covert efforts to disrupt the ongoing impeachment process targeting Governor Siminalayi Fubara and Deputy Governor Ngozi Odu. Lawmakers claim that certain actors are attempting to influence the process through judicial interventions.
In a statement released on January 11, 2026, the Assembly revealed that intelligence reports suggest some individuals are seeking ex parte court orders from High Courts outside the Port Harcourt Judicial Division. These orders, the Assembly warned, are intended to prevent lawmakers from carrying out their constitutional duties in the impeachment proceedings.
The statement, issued by Enemi Alabo George, Chairman of the House Committee on Information, Petitions, and Complaints, stressed that such attempts would violate the Nigerian Constitution. Specifically, Sections 272(3) and 188(10) of the 1999 Constitution (as amended) limit the jurisdiction of courts over elected officials’ tenure and prohibit judicial interference in impeachment matters.
Citing precedent, the Assembly highlighted recent Court of Appeal rulings that nullified similar ex parte orders in past impeachment cases, reinforcing that courts should not obstruct legislative processes.
The lawmakers also confirmed that both Governor Fubara and Deputy Governor Odu have been formally served with notices detailing allegations of gross misconduct and are expected to respond according to constitutional procedures. The Assembly criticized the purported interference as “covert actions” aimed at obstructing lawful legislative processes rather than allowing due procedure.
With the backing of Speaker Martin Chike Amaewhule, the House called for calm among all parties and urged strict adherence to the rule of law. They emphasized their dedication to constitutional governance, affirming that intimidation or unauthorized legal maneuvers will not derail the impeachment process.
Analysis
This development underscores the tension between legislative authority and judicial overreach in politically sensitive matters. Attempts to obtain ex parte court orders to stall impeachment could undermine democratic accountability if not checked. Observers note that the Assembly’s public warning serves both as a deterrent and a statement of resolve to protect its constitutional mandate.
The situation also highlights the importance of clear legal frameworks in impeachment processes to prevent external actors from manipulating outcomes for political advantage. Maintaining transparency and adherence to constitutional provisions is essential to preserve public trust in governance.
