Why Dangote Withdrew Petition Against Former NMDPRA Boss – New Details

Billionaire businessman Aliko Dangote has reportedly withdrawn his petition against Farouk Ahmed, the former CEO of the Nigerian Midstream Downstream Petroleum Regulatory Authority (NMDPRA), following revelations about potential conflicts of interest linked to Ahmed’s family.

Sources familiar with the matter told Leadership that Dangote’s decision was influenced by the fact that Ahmed’s spouse occupies a significant position at the Independent and Corrupt Practices Commission (ICPC). Concerns arose that this could interfere with the petition’s handling.

“After the petition was filed, it came to light that Ahmed’s spouse holds a key position in ICPC. Although no one is certain how that might play out, there are concerns of interference,” a source explained.

Legal Context of Petition Withdrawal

According to legal experts, a petitioner is allowed to withdraw a petition from one prosecuting agency and, if desired, submit it to another, provided the same petition is not pursued in two agencies at the same time. Lilian Ojimma, Principal Partner at Abuja-based O’J Law Consult, clarified:

“The only condition is that the petitioner cannot file the same petition with two agencies simultaneously and pursue both at the same time.”

This ensures procedural fairness while preventing duplication of investigations.

ICPC Reassures Public

Despite Dangote stepping back, the ICPC has confirmed that its investigation into the matter will continue uninterrupted. Spokesperson John Odey emphasized the commission’s commitment to transparency:

“I am not aware of any person working in the ICPC who is married to Farouk. Even if that were true, I can assure you that nobody will interfere in the ongoing investigation. Dangote’s withdrawal of the petition does not mean the ICPC has stopped the investigation. The investigation continues.”

This statement aims to reassure the public that due process will be upheld and that no undue influence will compromise the probe.

Commentary

The withdrawal highlights how potential conflicts of interest, even perceived ones, can influence high-profile legal and regulatory disputes. It also underscores the delicate balance between private complaints and the independence of prosecutorial agencies. For Dangote, the move may reflect caution to avoid any perception of interference, while the ICPC seeks to maintain credibility by assuring continuity.
