The Chairman of the Independent National Electoral Commission, Joash Amupitan, has cautioned the African Democratic Congress (ADC) against proceeding with its scheduled congresses and national convention amid an ongoing legal dispute.
Speaking during a televised interview, Joash Amupitan stressed that the commission would not supervise any such activities, citing an existing court order tied to the party’s leadership crisis. He made it clear that proceeding under these circumstances could amount to a violation of judicial directives.
Gossip News Now reports that the INEC boss warned the party to maintain the current situation until the court delivers a final ruling, emphasizing that any premature action could have serious legal consequences.
Reference to Past Electoral Setbacks
To underline his concerns, Amupitan pointed to previous cases where similar situations led to unexpected outcomes. He referenced incidents in states like Zamfara and Plateau, where election victories were later overturned due to procedural and legal issues.
He suggested that even if candidates emerging from such disputed processes win elections, the courts could nullify those victories, potentially handing power to candidates who originally placed second.
At one point, he implied that ignoring legal boundaries in political processes could ultimately undermine the very success parties seek to achieve.
ADC’s Defiance Amid Legal Uncertainty
Despite the warning, a faction of the ADC aligned with David Mark has maintained its intention to move forward with planned political activities ahead of the 2027 elections. This stance reflects the party’s determination to stay active, even in the face of regulatory and legal challenges.
However, INEC insists that its position is guided strictly by the need to respect court proceedings and avoid interfering in matters currently under judicial consideration.
Call for Compliance With Court Orders
Joash Amupitan emphasized that adherence to court orders is essential for preserving the integrity of the electoral process. He suggested that any deviation could complicate future electoral outcomes and create avoidable disputes.
He also made it clear that the commission would not take actions—such as monitoring the party’s convention—that could influence a matter already before the courts.
Analysis: Legal Risks Versus Political Urgency
The standoff between INEC and the ADC highlights a broader tension between legal compliance and political momentum. While parties often seek to maintain visibility and preparedness ahead of elections, unresolved legal issues can significantly alter outcomes.
For the ADC, moving forward could energize its supporters but also expose it to the risk of invalidated victories. For INEC, maintaining neutrality and adherence to the law remains critical to safeguarding electoral credibility.
Ultimately, the situation underscores the importance of aligning political actions with legal frameworks, as failure to do so may lead to consequences that extend far beyond immediate electoral gains.
