Fresh legal controversy has erupted within the Labour Party (LP) following conflicting interpretations of a recent Federal High Court judgement concerning the leadership status of National Chairman Julius Abure. Party National Vice Chairman (South West), Abayomi Arabambi, has strongly rejected claims that the Supreme Court declared Abure’s tenure expired.
During a televised interview, Arabambi maintained that the apex court never issued such a pronouncement, arguing that the ruling currently being relied upon by critics represents a misunderstanding of judicial authority and constitutional limits.
He stressed that the Supreme Court’s decisions are final and cannot be reinterpreted or expanded by lower courts. According to him, any attempt by another court to attach new meanings to an existing Supreme Court judgement amounts to a procedural overreach.
Disagreement Over Judicial Interpretation
Arabambi specifically faulted the reasoning behind the Federal High Court decision delivered by Justice Peter Lifu. He argued that references suggesting Senator Nenadi Usman had been affirmed as party leader were inaccurate and inconsistent with the original judgement delivered earlier by the Supreme Court.
Reframing his position, he explained that what some observers treated as binding law was merely judicial commentary rather than the operative part of the ruling. In his view, elevating advisory remarks into enforceable conclusions created the present confusion within the party.
He emphasised that Nigeria’s Constitution grants only the Supreme Court the authority to clarify or revisit its own verdicts, making any alternative interpretation legally questionable.
Appeal Filed as Party Challenges Ruling
Beyond disputing the legal interpretation, Arabambi revealed that the Labour Party had already initiated steps to challenge the judgement. The party, he said, filed both an appeal and an application seeking a stay of execution to prevent immediate enforcement of the ruling.
He also highlighted procedural concerns surrounding the trial process. Among the issues raised were the alleged neglect of preliminary objections filed by the party and insufficient consideration of submissions made by the Independent National Electoral Commission (INEC).
According to him, the party was compelled to begin appellate proceedings despite not yet receiving the Certified True Copy of the judgement, a situation he described as irregular but not unexpected in politically sensitive cases.
Timeline of Abure’s Leadership
To reinforce the party’s position, Arabambi outlined the sequence of events surrounding Julius Abure’s emergence and continued leadership within the Labour Party.
He explained the progression as follows:
- Abure initially assumed national responsibility as party secretary in 2019.
- He later rose to the position of national chairman in 2021.
- When disputes disrupted normal timelines, the National Executive Council exercised its constitutional authority to extend his tenure.
- A national convention held in 2024, with electoral authorities duly notified, renewed his mandate.
Based on this chronology, Arabambi insisted that Abure’s leadership remains valid and legally protected.
Commentary & Political Analysis
The dispute reflects deeper tensions within the Labour Party following its rapid political rise after the 2023 elections. As parties expand quickly, leadership structures often face legal tests that expose ambiguities within internal constitutions and electoral regulations.
Arabambi’s argument centres on judicial hierarchy — a principle crucial to maintaining legal certainty in democratic systems. If lower courts reinterpret Supreme Court decisions freely, it could create competing authorities and prolonged political instability.
Observers note that the outcome of the appeal may shape not only Labour Party leadership but also broader political alliances ahead of future elections. Leadership legitimacy often determines control over party structures, candidate nominations, and strategic direction.
Ultimately, the legal battle is less about personalities and more about institutional control. Whether the courts uphold or overturn the contested ruling will influence how Nigerian political parties manage internal conflicts through legal mechanisms rather than factional confrontation.
